Terms of Service

1. Introduction

Welcome to CrowdBSC ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the CrowdBSC platform, including our website, services, and applications (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Platform Overview

CrowdBSC is a decentralized crowdfunding platform built on the Binance Smart Chain (BSC). The Platform enables creators to raise funds for their projects and allows backers to support these projects using cryptocurrency.

3. Eligibility

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Platform, you represent and warrant that you meet these requirements.

4. Account Registration

To use certain features of the Platform, you may need to connect a cryptocurrency wallet. You are responsible for maintaining the security of your wallet and for all activities that occur using your wallet.

5. Fees and Payments

By using the Platform, you agree to the following fee structure:

  • Platform Fee: 2% of all donations (e.g., from a 1 BNB donation, 0.98 BNB goes to the campaign and 0.02 BNB to the platform)
  • Campaign Creation Fee: 0.05 BNB one-time fee for creating a campaign
  • Network Gas Fees: Standard Binance Smart Chain gas fees apply to all transactions

These fees are used for platform operations, development, and maintenance to ensure a sustainable service.

6. Campaign Creation and Management

When creating a campaign, you agree to:

  • Provide accurate and truthful information about your project
  • Use funds raised for the stated purpose of your campaign
  • Comply with all applicable laws and regulations
  • Fulfill any promises or rewards offered to backers
  • Communicate regularly with your backers about project progress

7. Prohibited Activities

You may not use the Platform to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Create fraudulent or misleading campaigns
  • Engage in money laundering or terrorist financing
  • Harass, abuse, or harm another person
  • Distribute malware or other harmful content

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by CrowdBSC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9. User Content

By submitting content to the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. CrowdBSC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Limitation of Liability

In no event shall CrowdBSC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

12. Indemnification

You agree to defend, indemnify, and hold harmless CrowdBSC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

13. Governing Law

Legal Jurisdiction Disclaimer

CrowdBSC operates as a decentralized platform and does not target any specific jurisdiction. Users are responsible for ensuring their compliance with all applicable local, state, national, and international laws and regulations. By using the Platform, you acknowledge that you are solely responsible for determining whether your use of the Platform is legal in your jurisdiction.

These Terms shall be governed and construed in accordance with the laws applicable to international decentralized platforms, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
